The Patent Agents from the Intellectual Property Protection Section prepare application documentation, make applications for industrial property objects created at the University and conduct procedures before Patent Offices in order to obtain exclusive rights.

The application documentation includes, among other things, a description of the invention, which under Article 6 of the Regulation of the Prime Minister of 17 September 2001 on the filing and processing of applications for inventions and utility models (Dz.U. 2001.102.1119 of 21 September 2001) should specify the following information in the order listed below:

  • title of the invention,

  • field of technology,

  • description of the state of the art,

  • information about the essence of the invention,

  • indication of possible beneficial effects of the invention,

  • explanation of drawing figures,

  • example of the implementation of the invention,

  • indication of the possibility of industrial application of the invention.

On the basis of Poradnik wynalazcy [A Guidebook of an Inventor] edited by Andrzej Pyrża, the Team of Patent Agents prepared detailed guidelines concerning what a solution provided to the Section should include.

What are the stages of the process of obtaining protection for an invention?

  1. Preparation of the description of the solution by the creators.

  2. Filling in the Application Form.

  3. Providing a description of the solution together with the completed application form to a Patent Agent at Lodz University of Technology.

  4. Preparing an application description by the Patent Agent.

  5. Acceptance of the application description by the authors.

  6. Filing the invention application with in the Patent Office of Republic of Poland.

  7. Payment of a fee for the invention application.

  8. Proceedings before the Patent Office of Republic of Poland.

  9. Receiving the decision on granting a patent / right of protection.

  10. Payment of the fee for publication and the first protection period.

Filing the patent application to the Section must be made on the application form in accordance with the template set forth in Appendix 6 to the Regulations for management and commercialization of intellectual property rights in the Lodz University of Technology – The Resolution No.13/2021 of the Senate of Lodz University of Technology of 28 April 2021 and sent together with a description of this solution to Patent Attorneys' Office.

If the creators of the invention are not persons employed at Lodz University of Technology (e.g. students, doctoral students, retired people), the invention application should be accompanied by the concluded agreement on the transfer of their rights to Lodz University of Technology.

If Lodz University of Technology is not the only entity entitled to the given patent (the only applicant), the jointly entitled should enter into an agreement on the commonality of rights to and from the patent.
